1.1Â These terms and conditions of sale apply to all goods supplied by Hyperware Systems Ltd, whose registered office is at 8 Pilgrims Way, Ely, Cambridgeshire, CB6 3DL, registered in England & Wales company no.6883102. When placing an order please make sure you read these terms and conditions of sale carefully and keep a copy for your records.
1.2Â A binding legal contract is created once Hyperware Systems Ltd has received in full your payment (in cleared funds) and you receive our acceptance e-mail. It is at this point that these terms and conditions come into effect.
The contract is subject to your right of cancellation (see below)
These terms and conditions may be changed for future sales (by Hyperware Systems Ltd) without notice to you.Â
Order and Changes
2.1 Hyperware Systems reserves the right to make changes to order specifications but will identify any such changes by e-mail. Any such changes are guaranteed to be at least equivalent in performance to the original specifications. Should there be any significant variations to specifications the work will not be undertaken without the customer’s prior agreement.Â
2.2Â Any order placed with Hyperware systems shall be regarded as an offer by the customer to purchase products under the terms of this agreement.Â
2.3Â An order conformation will be sent to the customer. If Hyperware Systems accepts the customer's offer to purchase products under these terms and conditions, the order conformation means a binding agreement is in force between us. Any discrepancy between the offer and the conformation to be notified to Hyperware Systems promptly.Â
2.4Â The description and price of goods shown on Hyperware Systems website at the time of an order will be the description and price of goods received, upon full acceptance of your order by Hyperware Systems.
 2.5 Whenever it is not possible to accept your order to buy the goods at the specification and price indicated on the Hyperware Systems website, we will advise you by e-mail and offer to sell you the goods at the specification and price stated in the e-mail and which will also state the period for which this offer is valid.  An acceptance by you of this offer within the valid time frame will constitute a binding agreement with Hyperware Systems.Â
Delivery
3.1Â Any goods ordered will be delivered to the address provided when the order was placed.Â
3.2Â Immediate notice should be given to Hyperware Systems following delivery of any missing, damaged or not as otherwise ordered products.Â
3.3 The price of the goods doesn’t include the cost of delivery to you. The cost of delivering and the total price including delivery is displayed to you before confirming your order.Â
3.4Â At the time of delivery to your address, the risk of the goods will pass to you.Â
3.5Â All effort will be made to deliver the goods within the estimated time of delivery. Hyperware Systems is not liable for any loss or damage incurred by you due to reasonable or unavoidable delays in delivery.Â
3.6Â You must sign for the goods on receipt, please check that the goods are in good condition.Â
3.7Â Where the product is to be validly returned to Hyperware Systems, it should be made available for collection at a time which is mutually convenient.Â
Price, Payment and Quotations
4.1 The Price of goods and/or services will be shown on Hyperware Systems order conformation and invoices. Â
4.2Â The prices shown on the Hyperware Systems website are updated regularly and every effort is made to ensure the prices are accurate. If at the time of placing an order, an error is found, Hyperware Systems will e-mail you as soon as possible with details of the correct price where you may reconfirm or cancel the order. If fourteen days pass after informing you of the error, Hyperware Systems will automatically cancel the order. If cancelled, any sum that has been paid by you or debited from you credit card will be refunded by Hyperware Systems.Â
4.3Â Payment for the goods ordered and delivery cost shall be made before supply and/or delivery. On no account will the services and/or goods be supplied before Hyperware Systems is in receipt of cleared funds.Â
4.4Â Payment may be made by any method shown on Hyperware Systems website.Â
4.5. Hyperware Systems quotations are valid only if in writing & for 10 days after the quotation date, unless otherwise stated in the quotation.Â
Your Right of Cancellation
5.1Â You have the right to cancel the contract with Hyperware Systems at any time before the expiry period of 7 working days after you receive the goods.Â
5.2Â You may cancel the contract by giving Hyperware Systems notice by post to the address above. Hyperware Systems will only accept cancellations by post.Â
5.3 Goods custom made to the buyer’s specification (i.e. custom built) as described in section 13 of the distance selling regulations 2000 cannot be returned under the 7 working day “cooling off periodâ€.Â
5.4Â On cancellation of the order Hyperware Systems will refund the price paid, less the direct cost of recovering the goods within a period of 30 days from the date of cancellation.Â
5.5Â The customer under these terms has a duty of care to take care of the goods so that they maybe sold as new by Hyperware Systems. For any goods that may not be sold as new, Hyperware Systems will claim from the buyer any resulting loss in value.
 5.6 Your statutory rights are not affected by your right of cancellation.Â
Warranty
6.1 All products supplied by Hyperware Systems are covered under our own 24 month warranty in addition to any manufacturer’s warranty. Our warranty will cover our products for any hardware related problems for 2 years from the date of purchase.Â
6.2 Hyperware Systems will not cover your product from problems resulting from fair wear and tear, misuse, wilful damage, accidents, and installation of malicious software or manufacturer’s driver defects.Â
6.3Â Hyperware Systems warranty is void if any hardware is replaced or removed without contacting us first.Â
6.4Â Hyperware Systems warranty is a 24 month return to base, and covers all costs incurred from labour charges, hardware replacement and all transit costs.Â
Liability
7.1Â Hyperware Systems under no circumstance will be liable for any indirect, incidental or consequential damages.Â
Data Protection
8.1Â All reasonable precautions will be made to keep the details of your order and payment secure. Hyperware Systems will not be liable for any unauthorized access to information supplied by you unless the Hyperware Systems is deemed to be negligent in handling data.Â
Applicable Law
9.1Â These terms of sale and the supply of the goods will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.Â
9.2Â If any part of these terms and conditions shall be found unlawful, it shall not affect the validity or enforceability of the remainder of the terms and conditions.Â
WEEE Regulations
10.1Â In order to comply with WEEE obligations, we offer to take back your old equipment on a like for like basis for any new equipment bought (i.e. your old pc system for a new bought pc system) free of charge, which we reserve the right to dispose of without reference to you.
10.2 If you give any equipment to us for recycling please make sure that all your data is removed from the pc. We are not and shall not be held responsible for your data. If you wish, we are able to totally wipe and destroy all your system data from your hard drive for a fee of £10 per drive. Please contact us for details.Â
